The petitioner apprehends his arrest in connection with Kalyanpur P.S. Case No. 193 of 2019, registered under Sections 363, 366(A), 323, 504 and 506/34 of the Indian Penal Code.

The accusation is of kidnapping of daughter of the informant, Babita Kumar, by the petitioner with the help of his other family members.

Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case with ulterior motive, in fact, statement of victim, daughter of the informant, under Section 164 Cr.P.C. was recorded on 02.08.2019, in

Patna High Court CR. MISC. No.60445 of 2019(2) dt.24-09-2019 2/2 which, she stated that she had gone to village Kesariya for doing worship and in the way, she had also gone to her maternal uncle at village Mananpur, Kalyanpur Police Station, regarding which, she has not given information to her mother. The petitioner has no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, East Champaran, Motihari, in connection with Kalyanpur P.S. Case No. 193 of 2019, subject to the condition as laid down under Section 438(2) of the Cr.P.C. (Rajendra Kumar Mishra, J) Bhardwaj/- U T
