The petitioner apprehends his arrest in connection with Dhaka P.S. Case no. 215 of 2019, registered under Sections 409 of the Indian Penal Code.

The accusation is that petitioner being the supplier/agent to complete the work under Nal-Jal Yojna received Rs. 12,00,000/- out of Rs. 12,69,000/- for ward No.6 of Panchayat-Raj Karmawa, but the aforesaid work has not been completed.

Learned counsel for the petitioner submits that, admittedly, the petitioner received Rs. 12,00,000/- out of Rs. 12,69,000/- to complete the work under Nal Jal Yojna in ward No.6 of Panchayat-Raj Karmawa, but the work could not be completed due to some hurdles, while some work has already been done. In view of the undertaking of the petitioner to complete the entire work of Nal Jal Yojna in ward No.6 of Panchayat-Raj Karmawa, let the above named petitioner, be released on provisional bail for a period of four months, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Sub-Divisional Judicial Magistrate, Sikrahana at Dhaka, East Champaran at Motihari in connection with Dhaka P.S. Case No. 215 of 2019, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.

with further condition that petitioner will submit certificate issued by the competent authority regarding completion of the entire work of Nal Jal Yojna in ward No.6 of Panchayat-Raj Karmawa within four months, if the petitioner fails to submit the aforesaid certificate within the stipulated time, the court below shall be at liberty to cancel the bail bond of the petitioner.
