Let the defect(s), as pointed out by the office, be removed within a period of four weeks from today. The accused/petitioners are named in the F.I.R. and apprehend their arrest in connection with Punaura P.S. Case No. 129 of 2022 registered for the offences punishable under Sections 376, 420 and 120B/34 of the Indian Penal Code and Sections 4 and 12 of POCSO Act.
The allegation against both petitioners is to help in kidnapping and sexual assault upon informant/victim to main co-accused, namely, Ravi Shankar @ Bhola and also to record
Patna High Court CR. MISC. No.69581 of 2022(2) dt.27-04-2023 2/3 objectionable video, where, threat was advanced to make the video viral.
Learned counsel appearing on behalf of the petitioners submitted that these petitioners implicated in this case only for the reason that they are parents of the main co-accused, namely, Ravi Shankar @ Bhola. It is submitted that petitioner No.1 is father and petitioner No.2 is mother, who is suffering from cervical cancer. While concluding the arguments, it is submitted that both the petitioners are men of clean antecedent and moreover, thrust of allegation is available against their son, namely, Ravi Shankar @ Bhola.
Learned APP duly assisted by learned counsel appearing on behalf of the informant, opposes the prayer of bail. Considering the aforesaid facts and circumstances of the case, as petitioners are parents of main co-accused, namely, Ravi Shankar @ Bhola, let both above named petitioners, in the event of their arrest or surrender within a period of four weeks, from the date of order, are directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Session Judge-VI-cum-Special Judge (POCSO Act), Sitamarhi/concerned Court, where the case is
