Petitioner apprehends arrest in a case registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

As per prosecution case, 35.980 litres illicit liquor has been recovered from egg shop of co-accused Dharmendra Baitha.

Learned Counsel for the petitioner submits that the petitioner has falsely been implicated in this case. No incriminating material has been recovered from the conscious possession of the petitioner. Petitioner is a lady and has got no criminal antecedent.

Considering the aforesaid facts and circumstances, let

Patna High Court CR. MISC. No.65100 of 2022(2) dt.16-12-2022 2/2 the above named petitioner in the event of her arrest/surrender before the court below within a period of thirty days from the date of receipt/production of copy of this order, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional District Judge-cum-Exclusive Special Excise Court No.-II, Siwan in Raghunathpur P. S. Case No. 234 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
