The petitioner is in custody since 19.08.2019 in connection with Siwan Muffasil (Mahadeva) P.S. Case No. 321 of 2019 for the offence registered under Sections 272 and 273 of the Indian Penal Code and Section 30 (a) and 37 (b) of the Bihar Prohibition and Excise (Amendment) Act, 2018. Learned counsel for the petitioner submits that nothing was recovered from the conscious possession of the petitioner and the only allegation against him is that he was found to be in drunken condition.

Considering the aforesaid facts and circumstances of the case and that the petitioner has no criminal antecedent, let
