The petitioner has been in custody since 10.06.2018 in connection with Bahadurpur P.S. Case No. 136/2018 registered for the offences punishable under Sections 419/420 of the Indian Penal Code and Section 10 of the Bihar Examination Act. Learned counsel for the petitioner submits that false and frivolous allegation has been made against the petitioner and the purported cover of the finger print of the candidate which had fallen down resulting in the arrest of the present petitioner has not been marked as a seizure in the First Information Report. It is further submitted that, at best, a case under Section 419 of the Indian Penal Code can be made out against the petitioner and the same is bailable.

No.43311 of 2018 (3) dt.20-08-2018 2/2 In view of the aforementioned facts and circumstances and that the petitioner has got no criminal antecedent, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-II, Patna City, Patna, in connection with Bahadurpur P.S. Case No. 136/2018.
