The petitioner, already in custody since 19.05.2018, seeks bail in connection with Bodh Gaya P.S.Case No. 302 of 2018 registered under Sections 120B and 307 of the Indian Penal Code, Section 14 of Foreigner Act 1946 and Sections 3, 5, 6 and 7 of the Immoral Traffic Act.

Accusation in brief, is that, this petitioner is the owner of a Guest House and in the garb of that was running a brothel and police apprehended some call girls along with their customers.

Learned counsel for the petitioner submits that the girls recovered by the Police from the Guest House, in fact, they had booked the room and in their statements recorded under

Patna High Court Cr.Misc. No.46224 of 2018(3) dt.09-08-2018 2/2 Section 164 also reflect same position and they have not stated about indulging in any immoral trafficking and this petitioner has no criminal antecedent.

Having considered the aforesaid facts and circumstances, the petitioner, namely, Uma Shankar Patel is directed to be released on bail upon furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the learned CJM, Gaya in connection with Bodh Gaya P.S.Case. No. 302 of 2018.
