1. Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. The petitioner apprehends his arrest in a case registered for the offence punishable under Section 409 of the Indian Penal Code.
3. Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and is a woman and has been falsely implicated in the instant case with an allegation that an amount of Rs. 14,91,000/- allocated under the scheme of Mukhyamantri Gramin Peyjal Nischay Yojana has been misappropriated by the petitioner and others. The learned counsel next submits that the case was taken up on 02.11.2023 when a report was called for from the District Magistrate, Vaishali at Hajipur with respect to the scheme in question. It is

From perusal of letter no.61 dated 08.01.2024 issued by the District Magistrate, Vaishali, it manifests that the work has been completed.
4. Learned A.P.P. for the State also does not oppose the anticipatory bail application of the petitioner in view of the letter of the District Magistrate, Vaishali dated 08.01.2024.
5. Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Rajapakar P.S. Case No.326/2021, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
