2. The petitioner has prayed for bail in connection with Mahila (Bagaha) P.S. Case No. 24 of 2025 registered for the offence punishable under Sections 126(2), 115(2), 69, 89, 352, 351(2), 3(5) of the B.N.S., 2023 and Section 4 of the D.P. Act.
3. The case of the prosecution is that the petitioner has established physical relationship with the informant on the false promise of marriage. It is further alleged that due to the physical relationship, the informant got pregnant and was administered medicine due to which, abortion took place. Further case is that
Patna High Court CR. MISC. No.67249 of 2025(2) dt.18-09-2025 2/3 the petitioner and the informant were living in a room at Chanpatia, where she was being raped. It is also alleged that when she forced to marriage, the petitioner demanded Rs. 3,00,000/- and a bike.
4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. He has been falsely implicated in this case. He also submits that from perusal of the FIR, it is clear that the petitioner and the informant were living in live-in relationship, and that she is forcing marriage, whereas she is already married. From perusal of the FIR, it is also clear that there is no specific date has been mentioned on which the petitioner allegedly committed the offence with the informant, and the only date of occurrence is 03.05.2025, when she was being assaulted by the petitioner and his family members. Admittedly, the petitioner and the informant were in a live-in relationship, and some dispute has arisen as the petitioner is not ready to marry her. He further submits that a statement has been made in para 3 of the petition that petitioner has no criminal antecedent and he is languishing in judicial custody since 29.06.2025.
5. The application for bail is opposed by learned APP
Patna High Court CR. MISC. No.67249 of 2025(2) dt.18-09-2025 3/3 for the State.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Bagaha, West Champaran in connection with Mahila (Bagaha) P.S. Case No. 24 of 2025.
