2. The petitioners have prayed for regular bail in a case registered for the offence punishable under sections 126 (2), 115 (2), 303 (2), 308 (2), 324 (4), 352, 351 (2), 3 (5) of the BNS.
3. The case of the prosecution is that the petitioner no. 1 allegedly pointed a revolver at the informant while petitioner no. 2 allegedly took an amount of Rs. 48,000/- from the box of a tempo and further threatened that he would have to pay Rs. 60,000/- as 'Rangdari' per month.
4. Learned counsel for the petitioners submits that the petitioners are innocent and have falsely been implicated in connection with the present case. It is further submitted that

The petitioner no. 1 has been framed in this case as he is having criminal antecedent of 12 cases whereas petitioner no. 2 is having criminal antecedent of two cases. It is further submitted that nothing has been recovered from the conscious possession of this petitioners. Moreover, the petitioners have been languishing in judicial custody since 28.06.2025
5. Learned APP appearing for the state has opposed the prayer of regular bail.
6. Considering the aforesaid facts and circumstances of the case, this court is inclined to enlarge the petitioners on bail. The above named petitioners are directed to be released on bail in connection with Baijnathpur P.S. Case No. 53 of 2025 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Saharsa.
