2. The petitioner is apprehending his arrest in connection with Buxar (Town) P.S. Case No. 208 of 2023, F.I.R. dated 17.04.2023 for the offences punishable under Sections 21, 22 and 27 of the N.D.P.S. Act.

3. Recovery is of 6.97 grams of Heroin like intoxicating substance.

4. Learned counsel for the petitioner submits that petitioner is innocent and he has falsely been implicated in the present case. He further submits that the allegation as alleged in the FIR is false and fabricated and the petitioner has not

He further submits that nothing has been recovered from the conscious possession of the petitioner. He further submits that the name of the petitioner has been transpired on the basis of the disclosure made by the apprehended co-accused person, namely, Ravi Sah @ Roushan Sah.

Learned Additional Public Prosecutor on the other hand vehemently opposed the prayer for bail of the petitioner and submits that the from a bare perusal of the statement of the co-accused person it appears that the petitioner was also involved in the present occurrence and apart from that the petitioner is also involved in three more cases of the N.D.P.S. matter other than the present one.

6. Considering the facts and circumstances of the case, I am not inclined to enlarge the petitioner on bail in connection with Buxar (Town) P.S. Case No. 208 of 2023 pending in the Court of learned District Judge cum Special Court, N.D.P.S. Court, Buxar.

7. Prayer is refused.
