JUSTICE BIRENDRA KUMAR ORAL ORDER 18-05-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is apprehending her arrest in a case registered for the offences punishable under Sections 409 and 420 of the Indian Penal Code.

Allegation against the petitioner is that while she was working as Principal of the school Rs.8,40,000/- was sanctioned for construction of additional room for the school. The petitioner did part work and misappropriated Rs.3,49,666/-. Submission is that the petitioner has already refunded the aforesaid amount through bank drafts at Annexure-6 series.

Considering the aforesaid facts, let the petitioner,

Patna High Court Cr.Misc. No.12479 of 2017 (4) dt.18-05-2017 above named, in the event of her arrest or surrender before the court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Khagaria/Successor Court in connection with Alauli P.S. Case No.290 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and subject to the further condition that petitioner shall fully cooperate with the investigation and trial of the case, failing which the Court below shall be at liberty to take steps for cancellation of the bail bonds of the petitioner in this case.
