JUSTICE SANJAY PRIYA ORAL ORDER 09-03-2017 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in Sahebganj P.S. Case No 163 of 2014 instituted for the offence under sections 323, 341, 379, 498A, 307, 467, 468, 471, 420, 452 of the Indian Penal Code.
It is alleged in the written report that this petitioner took thumb impression of the informant on few blank papers. It is mentioned in para-9 that informant after death of her husband, Khobhari Rai, she performed another marriage with Langtu Rai, son of Nagina Rai, resident of village-Madhopur Hazar, P.S.-Sahebganj, District-Muzaffarpur.
From the written report, it appears that besides such general allegation that this petitioner took thumb impression of the
Patna High Court Cr.Misc. No.10096 of 2017 (2) dt.09-03-2017 2/2 informant on few blank papers there is no any allegation of any overt act against him.
Considering the facts and circumstances of the case, prayer for anticipatory bail of the petitioner(s) is allowed. In the event of surrender/arrest of the petitioner named above, within six weeks from today, in connection with Sahebganj P.S. Case No. 163 of 2014, he shall be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., (West) Muzaffarpur, subject to the conditions as laid down under Section 438(2) Cr.P.C (Sanjay Priya, J) Ravi/- U T
