Heard learned counsel for the petitioner and learned A.P.P. for the State.
The petitioner seeks regular bail in connection with Barh P.S. Case No. 449 of 2022 lodged under Sections 302/120(B) of the I.P.C. and 27 of the Arms Act. As per the prosecution case, it has been alleged by the informant that his son was sitting near Savita Cinema Hall with his friends, in the meantime, the petitioner along with 3-4 persons visited there and started indiscriminate firing upon his son, due to which the informant's son and his friend namely Vinay Pandey were injured and referred to Patna for better medical treatment but both died on the way. The cause of
Patna High Court CR. MISC. No.64887 of 2022(2) dt.16-02-2023 2/2 dispute, as shown in the F.I.R. is that the son of the informant has solemnized love marriage with the daughter of the present petitioner, due to this reason he was consistently threating to kill informant's son.
Learned counsel for the petitioner has taken the plea that in the CCTV the informant has not identified the petitioner. Learned counsel for the State opposes the prayer for bail and submits that it is a case in which 2 innocent persons were murdered and this matter appears to be honour killing. The petitioner is not a man of clean antecedent rather there are 4 criminal cases pending against him.
In the present facts and circumstances of this case and the submissions made above, I am not inclined to grant bail. With this observation, the bail application stands rejected.
