1. Heard the parties.
2. The petitioner has renewed his prayer for regular bail in connection with Sessions Trial No. 381 / 2024 / 74 / 2024 arising out of Rafiganj P.S. Case No. 401 / 2023 registered for the offence punishable under section 304(B) / 34 of the I.P.C.
3. It is a case of dowry death. The petitioner is the husband of the deceased.
4. The bail application of the petitioner was earlier rejected on 20.09.2024 on merit vide Cr. Misc. No. 56608 / 2024.
5. Learned counsel for the petitioner submits that charges have been framed on 29.05.2024 but no prosecution witness has been examined as yet.
6. This court has called for a report regarding the status of trial vide order dated 12.09.2025 and in pursuance thereof
Patna High Court CR. MISC. No.64868 of 2025(3) dt.31-10-2025 2/2 learned District & Additional Sessions Judge-II, Aurangabad has submitted his report vide letter no. 387 / 2025 dated 19.09.2025 stating therein that there are altogether seven charge sheet witnesses and to ensure examination of witnesses summons and bailable warrants have already been issued at the stage of prosecution evidence but till date prosecution has not adduced any evidence.
7. Regard being had to the submissions made by the parties, taking into consideration the fact that this is second attempt for regular bail on behalf of the petitioner, who is in custody since 24.12.2023, accordingly, I am inclined to grant regular bail to the petitioner.
8. Let the petitioner, above named, be released on regular bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II, Aurangabad in connection with Sessions Trial No. 381 / 2024 / 74 / 2024 arising out of Rafiganj P.S. Case No. 401 / 2023. (Anil Kumar Sinha, J) praful/- U T
