JUSTICE SANJAY PRIYA ORAL ORDER 01-10-2018 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Sessions Trial No. 302 of 2018 arising out of Chapra Town P.S. Case No. 154 of 2011 instituted for the offence under Sections 302, 120(B)/34 of the Indian Penal Code and Section 27(3) of the Arms Act. Counsel for the petitioner submits that petitioner was earlier granted anticipatory bail by this Hon'ble Court vide order dated 13.11.2013 passed in Cr. Misc. 17557 of 2013, but he could not surrender before the court below. Thereafter, petitioner has been arrested by the police. Counsel for the petitioner further submits that petitioner is in custody since 28.11.2017. Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. No.49900 of 2018 (3) dt.01-10-2018 2/2 petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District Judge 9th, at Chapra, in connection with Sessions Trial No. 302 of 2018 arising out of Chapra Town P.S. Case No. 154 of 2011, subject to the condition that both the bailors will be the close relatives of the petitioner.
