JUSTICE VINOD KUMAR SINHA ORAL ORDER 24-02-2020 Petitioner seeks bail in connection with Chapra Mufassil P.S. Case No. 347 of 2018, corresponding to S. Trial No. 386 of 2019, registered for the offences punishable under Sections 399, 402, 414 of the Indian Penal Code and Sections 25(1-B)(a), 26 and 35 of the Arms Act.

Allegation is of recovery of one loaded country-made pistol from the possession of the petitioner while accused persons, including the petitioner were preparing for committing dacoity.

Submission of learned counsel for the petitioner is that he has falsely been implicated, having no criminal antecedent and he is in custody for one and a half years. Heard learned APP also.

In view of above facts and circumstances, let

Patna High Court CR. MISC. No.74318 of 2019(4) dt.24-02-2020 2/2 petitioner be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional District Judge-III, Saran at Chapra, in connection with Sessions Trial No. 386 of 2019, arising out of Chapra Mufassil P.S. Case No. 347 of 2018.
