The petitioners seek regular bail in connection with Mirganj P.S.Case No. 26 of 2018, registered for the office under Sections 25 (1-b) and 26/35 of Arms Act.
Allegation against the petitioners as per F.I.R. is of recovery of one loaded country made pistol having one live cartridge from the possession of petitioner No.1 and one country made loaded pistol with one live cartridge and one mobile from the possession of petitioner No. 2. Both persons are also accused in 4-5 criminal cases.
Submission of the learned counsel for the petitioners
Patna High Court Cr.Misc. No.49358 of 2018 (3) dt.03-10-2018 2/2 is that the petitioners have falsely been implicated in this case and nothing has been recovered from the possession of the petitioners and the petitioners is in custody since 07.02.2018. Heard learned A.P.P. also who opposed the prayed for bail.
Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant bail to the petitioners at this stage. However, they may renew prayer for bail after framing of charge.
With the aforesaid observation, the instant petition is accordingly dismissed.
