The petitioner seeks bail in connection with Kahalgaon P.S. Case No. 389 of 2018 registered for the offence punishable under Sections 420 of the Indian Penal Code and Sections 18(C), 27(b)(ii) of Drugs and Cosmetics Act-1940 Amendment Act-1945.

Some medicines which were purchased in the name of other firms are said to have been recovered from possession of the petitioner.

It is submitted by learned counsel for the petitioner that the petitioner happens to be Medical Representatives and medicines recovered from his possession

Patna High Court Cr.Misc. No.54150 of 2018(3) dt.08-10-2018 2/2 are the physician sample. He has been languishing in custody since 14.06.2018. Hence, he deserves bail.

From perusal of impugned order, it appears that while rejecting the bail prayer of the petitioner, learned court below has given liberty to the petitioner to renew his prayer for bail after three months from 23.07.2018.

In the facts and circumstances, I am not inclined to enlarge the petitioner on bail. Accordingly, his prayer is rejected.

However, petitioner may renew his prayer for bail before the court below and learned court below shall dispose it of in accordance with law without being prejudiced by this order.
