The petitioner apprehends his arrest in Fatehpur P.S. Case No. 396 of 2021 registered for the offences punishable under Sections 467, 468 and 471 of the Indian Penal Code. The allegation against the petitioner is that he got appointed a number of candidates for the post of Anganbari Sevika by preparing forged certificates.

It is submitted that petitioner has been falsely implicated in this case. He is simply a Clerk-cum-Typist in the office of CDPO Fatehpur, Gaya. He is neither involved in the selection process of Anganbari Sevika, nor has played any role in the selection process of Anganbari Sevika. In fact, the petitioner earlier vide letter dated 25.05.2019, lodged a

Anita Devi and her husband regarding pressurizing him to give Rs. 50,000/- per month to them. It is further submitted that the so called appointment which was made on the basis of forged and fabricated documents has also been cancelled. Petitioner claims clean antecedent. Learned APP for the State has vehemently opposed the prayer for bail.

Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Xth, Gaya, in connection with Fatehpur P.S. Case No. 396 of 2021, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
