The petitioner is in custody since 27.08.2019 in connection with Lalganj P.S. Case No. 101/2019 registered for the offence punishable under Sections 30(a)/32(2),41(1) of the Bihar Prohibition and Excise Act.

Learned counsel for the petitioner submits that the alleged recoveries of foreign liquor had nothing to do with the present petitioner nor was he arrested from the spot. It is further submitted that the driver of the vehicle has not disclosed the name of the present petitioner and the alleged recoveries were not from his conscious possession. The petitioner is also not having any criminal antecedent.

In view of the aforementioned facts and

No.60441 of 2019(2) dt.30-09-2019 2/2 circumstances, let the petitioner above named be released on bail, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional District Sessions Judge II cum Special Judge Excise Act, Vaishali at Hajipur, in connection with Lalganj P.S. Case No. 101/2019.
