The petitioner is apprehending their arrest in connection with Bihariganj P.S. Case No. 12 of 2015 for the offence under Section 392 of the Indian Penal Code. Learned counsel appearing on behalf of the petitioner submits that the case was registered against unknown and during the course of investigation the name of the petitioner has surfaced. The learned counsel appearing on behalf of the State submit that the petitioner has tried to avoid the course of justice and even the prosecution has to take recourse to attachment in the instant case as evident from the case-diary. Considering the aforesaid, the application for grant of anticipatory bail he hereby rejected. However, the dismissal of

No.54192 of 2018(3) dt.12-12-2018 2/2 the anticipatory bail application will not cause prejudice to the petitioner and in the event, the petitioner surrender before the Court below and prays for regular bail, the Court below is hereby directed to dispose of the application for regular bail of the petitioner on the same day in accordance with law without being prejudice by this order.
