This is a petition for grant of regular bail for offence under Sections 395 and 397 of the Indian Penal Code.

The first information report of occurrence of dacoity is against unknown. Name of the petitioner has surfaced in the confessional statement of the co-accused. Thereafter, the petitioner is in custody since 20.05.2016. The petitioner was put on test identification parade, but, could not be identified. Nothing has been recovered from his possession and has stated, on oath, that he has got no criminal antecedent.

After going through the case diary, the learned counsel for the State does not dispute the aforesaid factual

Considering the aforesaid fact, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Nagar P.S. Case No. 664 of 2015 (G.R. No. 3164 of 2015) to the satisfaction of the Chief Judicial Magistrate, Katihar, or successor Court.
