Petitioner seeks bail in a case registered for the offences punishable under Sections 302/34 and 120 of the Indian Penal Code and 27 of Arms Act as well as 3/4 of Explosive Substance Act.

The petitioner is not named in the FIR. The informant is an eye witness of the occurrence of murder and FIR is specific regarding the assailants of the deceased. Submission is that some other co-accused have faced trial and have already been acquitted. Petitioner is in custody since 21.04.2015.

Considering the fact that there is no substantial material against the petitioner, let the petitioner, above

Patna High Court Cr.Misc. No.26333 of 2018 (6) dt.25-08-2018 2/2 named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Bariyarpur Police Station Case No.42 of 2011, Sessions Trial No.325 of 2015, subject to the condition that both bailors shall be resident of territorial jurisdiction of the learned court below and further the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
