JUSTICE VINOD KUMAR SINHA ORAL ORDER 08-01-2020 This is an application for grant of anticipatory bail in connection with Wazirganj P. S. Case No. 124 of 2018, disclosing offences under Sections 341, 323, 379, 506, 411 and 34 of the IPC.
As per F.I.R. while the informant was coming carrying the goods from a truck, the petitioner called him on phone and asked that his brother standing at the petrol pump at Manpur Gaya and take him also. It is also alleged that after that the brother of the petitioner met there and snatched Rs.20,000/- and taken away the truck along with articles and also snatched the driving license.
Submission of the learned counsel for the petitioner is that whatever allegation is that it is against the brother of the petitioner and not against the petitioner. He has been implicated due to earlier case lodged by the petitioner's side against the
Patna High Court CR. MISC. No.60081 of 2019(4) dt.08-01-2020 2/2 informant.
Heard learned A.P.P. also, who has opposed the prayer for anticipatory bail on the ground that there are allegations against the petitioner also, who has called the informant to stop the truck at petrol pump and thereafter, his truck was snatchedby his brother and same was recovered from the brother of the petitioner.
Having heard both sides, considering the submissions, made above, I am not inclined to grant privilege of anticipatory bail to the petitioner. He has to surrender before the learned court below and make prayer for regular bail. With the aforesaid, this application is dismissed. (Vinod Kumar Sinha, J) Sunil Shukla/- U T
