The instant appeal has been filed by the appellant against the order dated 05.08.2025 passed by learned District and Additional Sessions Judge-I-cum-Special Judge, Aurangabad whereby the prayer for bail of the appellant in connection with Aurangabad Mahila PS Case No. 54 of 2023 instituted under Sections 376, 342, 504 & 506 of the Indian Penal Code and Sections 3(i)(r)(s)(w)(i)(ii), 3(2)(v) of SC/ST Act was rejected.

This is the second attempt of the appellant for bail. The appellant has renewed his prayer for grant of regular bail
Patna High Court CR. APP (SJ) No.3618 of 2025(6) dt.17-07-2026 2/3 which was earlier rejected on merit by this Court vide order dated 27.09.2024 passed in Cr. Appeal (SJ) No. 2348 of 2024, taking into account the nature and gravity of the offence as also there being direct allegation of rape upon the appellant. 4.
In compliance of the order dated 18.09.2025, a report dated 26.05.2026 with regard to the present stage of trial has been received. From perusal of the aforesaid report, it appears that three (3) out of four (4) prosecution witnesses have been examined in this case. It is further reported that trial is likely to be concluded within a period of three months. 5.
Learned counsel for the appellant submits that the appellant is languishing in judicial custody since 22.02.2024, without any rhymes or reason, having one criminal antecedent. Learned counsel for the appellant submits that there is no likelihood of the trial being concluded in the near future, hence, appellant may be enlarged on bail.

Learned SPP for the State opposes the prayer for grant of bail. Learned SPP has further relied upon a decision of the Hon'ble Apex Court reported in 2024 SCC Online SC 3539 (X. vs. State of Rajasthan & Anr.), wherein in paragraph No.14, Hon'ble Apex Court has observed as under:
"14. Ordinarily in serious offences like rape, murder, dacoity,

There is no new ground to consider the bail petition of the appellant. From the aforesaid report, it appears that the trial is going on and is at an advance stage. 8.
In view of the above, this Court is not inclined to enlarge the appellant on bail. As a result appeal is again dismissed.
