The petitioner seeks bail in connection with Civil Line P.S. Case No. 175 of 2018 registered under Sections 420 and 379 of the Indian Penal Code.

The petitioner is said to have withdrawn Rs.

4,43,600/- from Canara Bank, G.B. Road Branch Gaya by presenting forged cheque of Canara Bank, Madhubani Branch. It is submitted by learned counsel for the petitioner that no such occurrence as alleged took place. He has no concern with the said occurrence. As a matter of fact, the petitioner was given a cheque by one Rajendra Prasad of Madhubani and he has deposited the aforesaid cheque in Canara Bank, G.B. Road Branch

Patna High Court Cr.Misc. No.54510 of 2018 (03) dt.08-10-2018 - 2 - Gaya and the cheque clearing officer after verifying the cheque number and signature of the drawer of the cheque with the Core Banking had cleared the cheque and the aforesaid amount was paid to the petitioner. Moreover, the police has not made any investigation by paying visit in Canara Bank Madhubani Branch. The petitioner has been languishing in custody since 06.06.2018. In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gaya in connection with Civil Line P.S. Case No. 175 of 2018.
