====================================================== CORAM: HONOURABLE MR. JUSTICE SUNIL DUTTA MISHRA ORAL ORDER 18-12-2024 Heard learned counsel for the petitioners and learned APP for the State.

2. The petitioners seek regular bail in connection with Khusharupur P.S. Case No.192 of 2024, registered for the offences punishable under Sections 341, 323, 504, 506, 304, 307/34 of the Indian Penal Code.

3. As per the prosecution case, petitioners alongwith their two brothers came to the math of informant and started assaulting him on his head by lathi and rod. Allegation against the petitioner no.1 is that he assaulted the informant on his head with intention to kill. During scuffle, mother of informant came to rescue him but the petitioners pushed her and she fell down on the ground and received injury thereafter during treatment she died.

4. Learned counsel for the petitioners submits that the

Patna High Court CR. MISC. No.71669 of 2024(3) dt.18-12-2024 2/2 petitioners are innocent and have been falsely implicated in this case. He further submits that the allegation against the petitioners are general in nature and there is no allegation of repetition of assault on the petitioners or other accused persons. Learned counsel submits that mother of the informant died due to accidental fall on the ground and the petitioners have played no role in this offence. He further submits that petitioners are young boys who are in custody since 23.05.2024 and there is no criminal antecedent of the petitioners.

5. Learned APP for the State has opposed the prayer for regular bail of the petitioner.

Considering the facts and circumstances of the case and the submissions of learned counsel for the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate-Ist Class, Patna City in connection with Khusharupur P.S. Case No.192 of 2024.
