JUSTICE VINOD KUMAR SINHA ORAL ORDER 29-03-2017 The petitioner is apprehending his arrest in connection with Dhanarua P.S. Case No. 326 of 2015 registered for offence punishable under section 498 (A)/34 of the Indian Penal Code and section 3/4 of the Dowry Prohibition Act. It has been submitted on behalf of the petitioner that the marriage of opposite party no. 2 was solemnized with the petitioner in the year 2008 and after marriage, she has left the house of the petitioner and now she has remarried with Amirak Bind which has been stated on oath in paragraph 8 of this application.
Heard learned A.P.P. also.

No.12588 of 2017 (2) dt.29-03-2017 2/2 Having heard both sides, in view of the aforesaid statement, let the petitioner surrender before the court below and file an application for regular bail, which will be considered by the court below considering the statement of learned counsel for the petitioner with respect to remarriage of the complainant and on such submission, the court below will release the petitioner on provisional bail on his furnishing bond of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to its own satisfaction in connection with Dhanarua P.S. Case No. 326 of 2015 and called upon opposite party no. 2 to verify the statement of the petitioner regarding her remarriage. If the statement of the petitioner is found true then his bail bond will be confirmed otherwise his bail bond shall be liable to be cancelled. Accordingly, this petition is disposed of.
