JUSTICE SANJAY PRIYA ORAL ORDER 06-10-2018 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Jakkanpur P.S. Case No. 341 of 2018 instituted for the offence under Sections 143, 384, 387, 379, 419, 420, 504, 506 and 120(B) of the Indian Penal Code.
The informant has alleged in the written report that he had constructed godown over the vacant land near Chanakya Management Institute at Mithapur Bus Stand and used to supply goods to the vendors. He is Secretary of Vendor organization. It is alleged that this petitioner and other accused persons used to collect Rs.50/- to 300/- per month from all the vendors under force and threat.
Counsel for the petitioner submits that there is general
Patna High Court Cr.Misc. No.59500 of 2018 (3) dt.06-10-2018 2/2 and omnibus allegation against the petitioner. The petitioner is authorized agent appointed by Bihar State Transport Corporation at Mithapur Bus Stand. The objection was raised by the petitioner for keeping illegal shed by the informant on the government land, then he has been falsely implicated in the instant case. Counsel for the petitioner further submits that now matter has been compromised between the parties and compromise petition has been filed in the court below.
Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Judge-I-cumACJM, Patna, in connection with Jakkanpur P.S. Case No. 341 of 2018, subject to the condition that both the bailors will be the close relatives of the petitioner.
