The petitioner seeks bail in a case registered under Section 394 of the Indian Penal Code.

Prosecution case in short is that while the informant was going to call at "Maulana", in the way, four persons riding on motorcycles, surrounded him near the orchard and snatched mobile and cash and on protest, he was assaulted. It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 29-06-2019. Charge sheet has already been submitted. The name of the petitioner has been disclosed by the co-accused. The petitioner has been falsely

Patna High Court CR. MISC. No.61035 of 2019(2) dt.25-09-2019 2/2 implicated in the present case. Except for suspicion, there is no other substantive evidence to suggest the implication of the petitioner in the present case. He has not been put on test identification parade to ascertain his participation in the alleged occurrence.

On behalf of the State, it is submitted that the petitioner is named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri Uday Pratap, learned Judicial Magistrate-Ist Class, Gopalganj in connection with Manjhagarh P.S. Case No. 364 of 2018.
