The petitioner has renewed the prayer for anticipatory bail in a case registered for the offences punishable under Sections 366, 323, 341, 379, 385, 420 and 120B of the Indian Penal Code which was later on converted under Sections 323, 341, 385, 120B and 498A/34 of the Indian Penal Code on the ground that though the petitioner earlier preferred Cr. Misc. No. 44508 of 2016 with a prayer for anticipatory bail but the same was permitted to be withdrawn vide order dated 28.01.2017 since the petitioner was arrested in connection with Patna City Chowk P.S. Case No. 221 of 2016.

It is submitted by learned counsel for the petitioner that now the petitioner has renewed the prayer for anticipatory

Patna High Court CR. MISC. No.12647 of 2017(3) dt.17-07-2019 2/2 bail since the apprehension of arrest still persists in the present case.

Considering the fact that the earlier anticipatory bail application of the petitioner was withdrawn, this Court is not inclined to interfere.

However, keeping in view the fact that the co-accused Deepak Kumar has been granted anticipatory bail, let the learned Court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders before the learned Court below within a period of six weeks from today in connection with Patna City Chowk P.S. Case No. 43 of 2016, pending in the Court of learned Judicial Magistrate, Ist Class, Patna City, Patna.
