2. The petitioner has preferred this application for grant of regular bail in connection with Azamnagar P.S. Case No. 208 of 2025 dated 22.06.2025 registered for the offences punishable u/ss 126(2), 115(2), 118(2), 109, 351(2) read with section 3(5) of the B.N.S.

3. As per the prosecution case, the informant's land was illegally captured by the petitioner and the other co-accused persons due to which a land dispute was going on between them. It is further alleged that on 21.06.2025, the petitioner along with the other co-accused persons with an intention to kill assaulted the informant with sickle due to which he sustained head injury and became unconscious.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this

From perusal of the impugned order, the injury report of the injured, it transpires that hair line fracture of left parietal bone has been found and the nature of injury is stated to be grievous in nature. Nothing has been recovered from the conscious possession of the petitioner. The co-accused person has already been granted regular bail by the Coordinate Bench of this court vide order dated 08.10.2025 passed in Cr. Misc. No. 67922 of 2025. The petitioner has clean antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 14.07.2025.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Katihar in connection with Azamnagar P.S. Case No. 208 of 2025.

7. The application stands allowed.
