JUSTICE VINOD KUMAR SINHA ORAL ORDER 06-11-2018 The petitioner seeks regular bail in connection with Keshariya P.S. Case No. 122 of 2018, registered for offences punishable under Section 302/34 of the Indian Penal Code. Allegation as per F.I.R that somebody entered inside the house of the informant and killed the daughter of the informant and assaulted the Devrani (sister in law ) of the informant and also taken away articles from the house. It has been submitted on behalf of the petitioner that he has not been named in the F.I.R., later on his name transpired during course of investigation and he has falsely been made accused in this case on account of previous enmity as the petitioner has lodged a case against the husband of the informant. Further petitioner has no criminal antecedent and
Patna High Court Cr.Misc. No.62025 of 2018(3) dt.06-11-2018 2/2 has been in custody since 05.05.2018.
Learned counsel for the State opposed the prayer for bail and submitted that Devrani (sister in law) of the informant has also received injuries and she has also named the petitioner.
Having heard both sides, considering the facts and circumstances of the case and the nature of allegation, I am not inclined enlarge the petitioner on bail.
This application is accordingly dismissed.
