The petitioner is apprehending her arrest in a case registered for the offences punishable under Sections 341, 323, 324, 307, 379, 504, 354 and 448/34 of the Indian Penal Code. Allegation of commission of assault at the head of the informant is against Satrudhan Prasad, the husband of this petitioner. Allegation against the petitioner is that she had brought Dab from which her husband assaulted to the informant. Further allegation is of commission of assault.
Both sides are family members.
Considering the aforesaid facts and the fact that the petitioner is a female, let the petitioner, above named, in the event
Patna High Court Cr.Misc. No.12878 of 2017 (2) dt.17-03-2017 2/2 of her arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran at Motihari/Successor Court in connection with Turkauliya (Banjaria) Police Station Case No. 11 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioner shall fully co-operate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
