2. Petitioners apprehend their arrest in a case registered for the offence punishable under sections 323, 341, 379, 307, 354(B), 354(d), 504, 506 and 34 of the Indian Penal Code.

3. As per the prosecution case, on the alleged and time of occurrence, the informant along with her sister's daughter was sitting on door and these petitioners along with other co-accused persons playing cricket in nearby street, suddenly the daughter of informant was hit by the cricket ball and when she opposed, then petitioner Nos.2 & 3 assaulted informant and her sister's

Patna High Court CR. MISC. No.70017 of 2024(4) dt.16-01-2025 2/2 daughter with bat and also misbehaved with them. When the family members of the informant came to save her, then all accused persons also assaulted them.

4. It is submitted by learned counsel for the petitioners that on account of playing cricket, an altercation took place between both the parties in which both side sustained injury. Allegation of assault is general and omnibus. Petitioners claim clean antecedent.

5. Considering the fact that allegation of assault is general and omnibus against these petitioners, clean antecedent of these petitioners and other circumstances of the case , in the event of arrest or surrender within six weeks from today, let the petitioners, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the learned court of J.M. 1st Class, Barh, Patna in connection with Bhadaur P.S. Case No. 53 of 2024, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Singh, J) Amandeep/- U T
