2. This is the second attempt of the bail by the petitioner.

3. The petitioner seeks regular bail in connection with Motipur P.S. Case No. 346 of 2016 registered for the offence punishable under Sections 323, 341, 324, 307, 379, 504, 34 of the Indian Penal Code.

4. As per the prosecution case, the petitioner is said to have assaulted the victim with knife. The petitioner is in custody since 08.07.2023.

5. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case. Learned counsel for the petitioner further submits that no strong motive

Patna High Court CR. MISC. No.70711 of 2024(2) dt.06-12-2024 2/2 has been assigned by the informant in the F.I.R. for the alleged incident. The petitioner has no criminal antecedent.

6. It has been submitted by learned counsel for the petitioner that the case has not been committed to the Sessions Court till 06.08.2024 i.e. till the filing of the bail application.

7. Considering the period of custody and petitioner has no criminal antecedent, the application for regular bail is allowed.

8. Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, 1st, West, Muzaffarpur /concerned Court in connection with Motipur P.S. Case No. 346 of 2016, with further condition: (i) That the petitioner, after being released on bail is directed to cooperate in the trial either by appearing personally or through his lawyer in the trial Court on each and every date fixed by the trial Court. Non compliance of the condition will result in cancellation of the bail bonds of the petitioner.
