Petitioner seeks bail in Madanpur P.S. Case No.166 of 2008 instituted for the offence under Section(s) 302, 307, 353, 332, 333/34 Indian Penal Code and Sections 25(1-b)a, 26, 27 of the Arms Act and Section 17 CLA Act.
Counsel for the petitioner submits that in the written report it is alleged that police recovered one spiral note book from the hut in which name of 134 persons were written and amongst those persons name of this petitioner was also mentioned.
It is alleged in the written report that four persons, as named in the written report, were apprehended from the hut, who were hiding themselves behind the hut.
Patna High Court Cr.Misc. No.57354 of 2018(4) dt.07-12-2018 2/2 In this manner, petitioner has been made accused only on the basis that his name finds mention in spiral note book. Petitioner is in custody since 06.03.2018.
In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-I, Aurangabad, in connection with Madanpur P.S. Case No.166 of 2008, subject to the condition that both the bailors shall be close relative of the petitioner.
