JUSTICE JYOTI SARAN ORAL ORDER 24-12-2013 Heard Mr. Akhauri Kamal Kishore Sahay, learned counsel for the petitioners and learned Additional Public Prosecutor for the State The petitioners are apprehending his arrest in connection with Sheohar P.S. Case No. 61 of 2013 for the offences punishable under Sections 323, 337, 353, 504 and 34 of Indian Penal Code.

The allegation against these petitioners is of obstructing the informant while he was escorting the undertrial prisoners from the Court premises to the Hazat.

Petitioners along with others were charged with assault and pelting and also of supplying wine etc. to the undertrials. Mr. Sahay, learned counsel for the petitioners with reference to the F.I.R. has submitted that whereas the case is

He further submits that despite the allegation of pelting there is no injury report. It is further stated that antecedent of these petitioners is clean.

Regard being had to the submissions of learned counsel, let the petitioners namely, Rajendra Ram, Mamta Devi, Most. Rukmini Devi and Champa Devi in the event of their arrest/surrender within four weeks from today, be released on bail upon each of them furnishing individual bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Sheohar in connection with Sheohar P.S. Case No. 61 of 2013 subject to the conditions stipulated under Section 438(2) of the Code of Criminal Procedure. (Jyoti Saran, J) Bibhash/-
