2. The petitioner apprehends arrest in connection with Bhagwanpur Hat PS Case No.191 of 2025 dated 13.05.2025, instituted under Sections 126(2), 115(2), 118(1), 109, 303(2), 352, 351(2), 3(5) of the Bharatiya Nyaya Sanhita, 2023.
3. The prosecution case, in brief, is that on the alleged night of occurrence barrat of the daughter of the informant came from Siwan. In the night, when the rituals were going on, the petitioner and other FIR named accused entered into the courtyard of the informant and fled away with the ornaments, suitcase, clothes etc. When the informant and others protested, they assaulted them. Specific allegation against the petitioner is that he assaulted the nephew of the informant on his head by

4. Learned counsel for the petitioner submits that there is specific allegation in the FIR that the petitioner assaulted Manjeet Kumar by means of knife on his head. It is further submitted that the injury report of Manjeet Kumar is annexed as Annexure- P/2 from which it will appear that one lacerated wound on the back of head size 3" x 1/3" x 1/4" and abrasion in mid of right thumb 1/2" straight were found and both were caused hard and blunt object. Nature of the injury was simple in nature which does not corroborate the allegation levelled against the petitioner. Lastly, it is submitted that the petitioner has no criminal antecedent.
5. Learned APP has opposed the prayer for bail.

Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Siwan, in Bhagwanpur Hat PS Case No.191 of 2025, subject to the conditions laid down in Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
