Petitioner seeks bail in a case registered for the offences punishable under Sections 27(b)(ii), 27(c), 27(d), 28, 28A, 28B of the Drugs and Cosmetics (Amendment) Act, 2008, Sections 274, 275, 276, 284, 420, 467, 468, 469, 471 and 120B of the Indian Penal Code, Section 12 of the Prevention of Cruelty to Animals Act, 1960 amended by 26 of the Central Act, 1982 and Section 163/164 of the Railway Act, 1989. Petitioner is Proprietor of Super Vaishali Laboratories at Telbigha, Rang Bahadur Road, Gaya. Petitioner had licence for manufacturing of biological medicine. A copy of the licence is at Annexure-2. The licence was valid till 18.03.2015. Certain medicines manufactured by the Company

Patna High Court CR. MISC. No.60241 of 2019(2) dt.30-09-2019 2/2 of the petitioner as well as of another Company were seized from the railway yards. The consignee and consignor were different person.

Submission is that the petitioner has no concern as to where the medicines were being despatched and who had despatched the same. Petitioner has got no criminal antecedent.

Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Patna Junction (Rail) Police Station Case No.186 of 2016, subject to the condition that both bailors shall be resident of territorial jurisdiction of the learned court below and further the petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
