2. The petitioner seeks regular bail in connection with Ahiyarpur P.S. Case No. 788 of 2023, registered for the offence punishable under Sections 419, 420, 467, 468, 401, 414, 379, 411 of the Indian Penal Code and section 4/21 of the M.M.D.R. Act, 1957 and 11/56 of the Bihar Mines illegal Transportation and Storage Rules, 2019 and 177, 192 (39) (56) of M.V. Act.

3. As per prosecution case, two trucks bearing the same registration number loaded the sand. The drivers of both the trucks were arrested. The petitioner is one of the driver of the truck and he has produced one challan dated 21st June, 2023.

4. Learned counsel for the petitioner submits that the

Patna High Court CR. MISC. No.68217 of 2023(2) dt.18-10-2023 2/2 petitioner is innocent and have falsely been implicated in this case. Petitioner has no criminal antecedent and he is in judicial custody since 24.06.2023.

5. Learned APP has vehemently opposed the prayer for bail.

6. Considering the aforesaid fact, this application is allowed.

7. Let the petitioner, above named, be released on bail, on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Muzaffarpur in connection with Ahiyarpur P.S. Case No. 788 of 2023.
