1. Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 147, 148, 149, 337, 338, 307, 353, 171(C) and 188 of the Indian Penal Code.

3. Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and the informant alleges that during Loksabha election, accused created ruckus at Booth Nos. 91 and 92, accordingly police came, when accused pelted stones causing injury to constables Manish and Raghuvansh, further 17 accused were identified, but 30-40 miscreants remained unidentified.

4. Learned counsel for the petitioner submits that petitioner has been falsely implicated in the instant case based

Patna High Court CR. MISC. No.68316 of 2024(2) dt.03-10-2024 2/2 on suspicion. It is further submitted that petitioner resides at a nearby place where the occurrence is alleged to have taken place and on hearing ruckus, he also went to the place of occurrence when he came to be implicated.

5. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Hisua P.S. Case No. 228 of 2024 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.

7. Accordingly, the instant anticipatory bail application stands allowed.
