The petitioner seeks bail in connection with Saharsa Sadar P.S Case No. 007 of 2017 registered for the offences punishable under Sections 147, 148, 149, 341, 342, 323, 307, 353, 224, 225, 188, 333, 336, 395, 504, 506 of the Indian Penal Code. Allegedly, 16 accused persons named in the F.I.R. along with 10 started assaulting the informant and other police personnel and snatched loaded rifle and bindolia having 25 cartridges and after arrival of other force the petitioner and other two accused persons were arrested and snatched rifle was recovered from bamboo clamp which was behind the house of Shubhak Ram.
Submission is of false implication and that the petitioner is not named in 16 persons who have assaulted the informant and other police personnel and further snatched rifle and
Patna High Court Cr.Misc. No.12054 of 2017 (2) dt.28-03-2017 2/2 cartridge, the petitioner has been apprehended later on, nothing has been recovered from possession of the petitioner, the injuries found on the person of the informant and other are simple except of one Kumod Jha which is grievous on left hand and, as such, the petitioner deserves sympathetic consideration. The learned A.P.P. opposes the prayer of bail. In the facts and circumstances stated above, the petitioner is directed to be released on bail on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of learned Chief Judicial Magistrate, Saharsa, in connection with Saharsa Sadar P.S. Case No.
007 of 2017, subject to the conditions that one of the bailors must be a near relative and another having sufficient immovable property within the territorial jurisdiction of the Court concerned and the petitioner shall remain present on each and every date during trial and the default on two consecutive dates on his part without any reason shall disentitle the petitioner from privilege of bail.
