2. The petitioner apprehends his arrest in a case registered for the offences punishable under Section 414 of the Indian Penal Code and section 8/20(b)(ii)(b), 8/20(b)(ii)(c) of the Narcotic Drugs and Psychotropic Substances Act.

3. As per the prosecution case, co-accused Shambhu Sahani was apprehended with 05 Kg of Ganja who disclosed the name of this petitioner, as the person who fled away from the place of recovery.

4. It is submitted by the counsel for petitioner that no narcotic substance has been recovered from conscious possession of this petitioner and he was not apprehended on the spot. On the disclosure of co-accused, name of this petitioner

Patna High Court CR. MISC. No.68565 of 2023(2) dt.19-10-2023 2/2 surfaced in this case. Petitioner claims clean antecedent.

5. Considering the facts aforesaid and clean antecedent, the petitioner above-named, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned District & Sessions Judge, Bettiah, West Champaran in connection with Sahodara P.S. Case No. 34 of 2023, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
