The petitioner seeks bail in Phulwarisharif (Janipur) P.S. Case No. 449/2016, registered for the offences punishable under Sections 376 and 420 of the Indian Penal Code. The victim alleged that the petitioner established physical relation with her on the pretext of marriage with her. Learned counsel for the petitioner submits that the victim is aged about 24 years old. She stated in her statement under Section 164 Cr.P.C. that both were in love with each other and they fled away from the house on 12.08.2016, but the petitioner left her alone. She further alleged that the petitioner established physical relation with her.

It appears that the victim is a major girl and she is a

Patna High Court Cr.Misc. No.12447 of 2017 (2) dt.22-03-2017 2/2 consenting party. The petitioner is in jail since 30.11.2016. Considering the facts aforesaid, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Patna in connection with Phulwarisharif (Janipur) P.S. Case No. 449/2016.
