2. The petitioner seeks bail in a case registered for the offence punishable under Sections 30(a) of the Bihar Prohibition& Excise Amendment Act.
3. The case of the prosecution is that altogether 310.5 liters of foreign liquor was recovered from the house of late Sukhdeo Ram kept in husk.
4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in this case. It is further submitted that recovery has been made from behind the house of late Sukhdeo Ram and he has no concern with the seized liquor. It has been submitted that from perusal of the seizure list, it will transpire that the witnesses are police
Patna High Court CR. MISC. No.70140 of 2025(2) dt.07-10-2025 2/2 personnel and the seizure list does not contain the signature of the petitioner. The petitioner is in custody since 02.07.2025 having one criminal antecedent in which he is on bail.
5. The learned APP for the Stat vehemently opposes the prayer for bail of the petitioner.

Considering the fact and circumstances of the case and submissions of the parties, let the above named petitioner, be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand)with two sureties of the like amount each to the satisfaction of the learned Exclusive Excise Judge 1st, Jamui in connection with Giudhaur P.S.
