JUSTICE BIRENDRA KUMAR ORAL ORDER 09-01-2019 Heard learned counsel for the petitioner learned counsel for the informant and learned A.P.P. for the State. The petitioner is apprehending his arrest in connection with Dagarua P.S. Case No. 85/2018, registered for the offences punishable under Section 304 and 34 of the Indian Penal Code. According to the F.I.R., the petitioner assaulted husband of the informant as a result whereof he died. The doctor found the cause of death as strangulation. Thereafter, one of the witnesses stated before the police that son of the petitioner had caught the neck of the deceased which was cause of death. Learned counsel for the informant opposes the prayer for bail of the petitioner.
Considering the facts aforesaid, let the petitioner above-named, in the event of his arrest or surrender before the
Patna High Court Cr.Misc. No.63208 of 2018(3) dt.09-01-2019 2/2 court below within a period of thirty days from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs. 20,000/- (Twenty thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Purnea in connection with Dagarua P.S. Case No. 85/2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioner shall fully co-operate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
