====================================================== CORAM: HONOURABLE MR. JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 15-05-2023 Heard learned counsel for the petitioner, learned counsel for the O.P. No.2 and learned APP for the State. The petitioner apprehends his arrest in a case registered for the offence punishable u/s 341, 323, 379, 506 and 34 of the IPC and 3⁄4 of the Dowry Prohibition Act. Later on section 498 (A) of the IPC was added.

The parties are physically present in the Court. In para-13 of the bail application, petitioner has stated that he is ready to keep the informant with full honour and dignity and undertakes to fulfill her general necessity as per his capacity. He states the same in the Court. The informant/O.P.

Patna High Court CR. MISC. No.65017 of 2022(3) dt.15-05-2023 2/2 No.2 is also ready to live with her husband.

Under the aforesaid circumstances, let the above named petitioner, be released on provisional bail for a period of six months from today, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending/successor Court in connection with Jairampur P.S. Case No.15 of 2021, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.

Petitioner and O.P. No.2, both agrees to appear before the learned Court below on 06th June, 2023 and from there itself, the petitioner will bring the O.P. No.2 with him to his house, after filing an affidavit in the Court below, stating therein that he is ready to keep the O.P. No.2 with him.

The provisional bail of the petitioner shall be confirmed by the learned court below itself after six months after verifying that both parties are residing together.
