2. The petitioners apprehend their arrest in connection with Sasaram (M) P.S. Case No. 462 of 2023 registered under Section 30(a) of the Bihar Prohibition and Excise Act.
3. As per prosecution case, altogether 30 litre illicit liquor was recovered from the spot. Petitioners managed to flee away from the spot. The local Chaukidar disclosed the name of the petitioners.
4. Learned counsel appearing on behalf of the petitioners submits that petitioners are innocent and have falsely been implicated in the present case due to village politics. Further
Patna High Court CR. MISC. No.74341 of 2023(4) dt.07-05-2024 2/2 submission is that nothing has been recovered from the conscious possession of the petitioners rather the alleged recovery was made from mountain near the Marai Tola. Petitioners have no concerned with the alleged recovery. Petitioners claim clean antecedent.
5. Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned court below within a period of six weeks from today, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Exclusive Special Excise Court-II-cum-Additional District and Sessions Judge, Rohtas at Sasaram in connection with Sasaram (M) P.S. Case No. 462 of 2023, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
